Abstract:Section 214 of the Insolvency Act 1986, making directors potentially liable for certain losses of the company incurred in the run up to insolvent liquidation, is now a familiar part of the corporate scene, especially in the recessionary times. For a claim to be sustained, it is necessary to identify a particular point in time beyond which individual directors should have acted with due regard to creditors' interests. The purpose of this article is to examine how the courts may make such an unfamiliar assessment.
