| Abstract: | The purpose of compulsory composition is not enforcement of the debts of the creditor versus the debtor therefore in this procedure the creditor does not lose the debt due to omission of declaration.Bankruptcy proceedings is a special form of executive proceedings and/or the proceedings of the general execution.When a bankruptcy proceedings is instituted against a debtor, the claims against this debtor can be enforced only in this proceedings and in the terms and ways provided by the statute of compulsory composition, bankruptcy and liquidation as a lex specialis. |
