| Abstract: | The ways of realization of the assets of the bankrupt, provided by the ZPPSL, are defined well enough to give the organs of bankruptcy proceedings the possibility for successful execution of sale.The antagonism - quick realization of the bankrupt's estate - the selling price - needs to be solved for the benefit of quick realization. Quick realization of course does not mean instant sale to the first buyer, at any price, but timely, quick and quality implementation of market activities, which are specific in bankruptcy proceedings, and preparation of sale and quick making of contract with the best bidder at that moment.If there are no concrete facts, which could be the basis for conclusions on better market moment in future, the postponing of the realization of bankrupt's estate is not opportune.The responsibility for correct and quick realization of the bankrupt's estate, for a well executed preparatory actions and for correct realization of the bankrupt's estate lies primarily on the official receiver. |
