Abstract:New rules codify existing practices in an attempt to improve enforcement of commercial arbitration awards. In 1985, China National technical Import & Export Corp. (CNTIC) brought a case in the Shanghai Intermediate People's Court, alleging that swiss Industry Resources Inc. had committed fraud by forging the bill of lading and other documents required by the letter of credit. The Swiss company, invoking the broad arbitration clause in its business contract with CNTIC, objected to the court's jurisdiction over the case.
