Abstract:The constitutional rights of one class of share are in many instances affected by an alteration of the constitutional rights of another class just as much as if their own constitutional rights are directly altered. The test of change in all such cases makes the matter turn on status. The point is significant because of certain provisions of company law which prohibit the "variation" or "abrogation" of the rights of a class of share without its consent. These provisions would seem, on the above reasoning, to apply on an alteration in the constitutional status of a class howsoever made.
