Abstract: | In terms of legal systems of commercial banks across the Straits on legislation, definition and business scope, establishment, change, determination, take-over and stop doing business, some practices are more or less alike and some are obviously different. For instance, the commercial banks in the mainland are allowed to conduct inter-bank loan business and exchange dealings and grant long-term loans while the banks in Taiwan are not allowd to grant long-term loans. Besides, the commercial banks in the mainland are allowed to declare bankrupt while the banks in Taiwan are not allowed to do so. At the same time, the commercial banks in Taiwan need to clear up debts by themselves after stoping doing business while in the mainland, there is an organization for "take-over" established by the People's Bank of China responsible for the commercial banks after "bank take-over". |
