Abstract:Anti-trust laws have taken on increasing importance in Europe over recent years. But there remains a problem of articulation between the purely organizational logic of their application and the logic of action demanded by the politicians. This is illustrated through a comparative analysis of anti-trust legislation applied in France, Germany and Great Britain. Three major organizational equilibriums - between reflection and decision, between independence and control, between law and economics - are examined. These equilibriums are required in order to ensure the efficiency of governmental policies.
