Abstract:This paper examines provisions, which provide for the avoidance of certain kinds of transactions such as preferences, entered into before a company goes into liquidation. While there are many similarities in the provisions of the respective countries, there are some differences. While the English avoidance scheme is easier to comprehend than the Australian, the provisions in the latter are used more frequently by liquidators in attacking pre-liquidation transactions.
