Abstract:Companies are increasingly using pre-employment medical "gatekeeping" to reduce their susceptibility to sickness absenteesm. The author reports on the legal issues raised by this trend in the light of the Disability Discrimination Act. Pre-employment health screening made the news recently when a television executive was turned down for a job because of his drinking habits. The individual later lost his claim for damages against the doctor who, having examined the applicant, had concluded that his work could be adversely affected.
