Abstract:The study examines whether the European law is amenable to accommodate the iconsumer’s needs in distributing music and film on the mass-market. The problem in European consumer protection law is the extent of the service provider’s obligations to inform consumers on the main characteristics of a digital entertainment product. Often consumers do not know what they can and cannot do with their digital hardware and content. In addition, consumer as a weaker party in transaction have often no other choices but accept or refuse the restrictive terms of use, even if these could be regarded as unfair. This unclarity could be solved either in the general framework of consumer protection law or within the copyright act.
