Abstract:The author of this article answers the question what will happen if the European Commission follows the US lead, and allow patents to be granted on software programs and business methods. The increase in patent granted has prompted complains over 'bad' patents. Some claim that many patents should not have been granted because they don't pass the 'new and not obvious' test, or because while a way of doing business over the Internet may use new technology, that alone doesn't make it a new invention. The article also states that companies should spend more time gaining competitive advantage by developing their product and brand rather wrapping it up in patents.
