Abstract:This article considers electronic hotel reservations as contracts and how lodging companies should bring out the terms and conditions (hereafter as TaC) on their website from the legislation point of view. Many online hotel reservations have click wraps or browse wraps. In those cases customers can read up on the TaC before an internet reservation can be made. The paper provides generalized useful suggestions how to improve the probability of a court's enforcing the TaC contained on a hotel's website.
