Abstract:The current process of environmental regulatory modernization is characterized by new business- government relations. Innovative forms of cooperative governance and legal learning mechanism are central to the possibilities of a modern regulatory design. This cooperative approach aims at enlisting entrepreneurial expertise, mobilizing organizational capacities, and stimulating innovative processes. As the borderlines between public-private roles become more and more blurred, proactive and powerful corporations become fully aware of their status as "institutional Rather than passively allowing environmental affairs to entrepreneurs" (original in German).
