Abstract:The concept of unethical competition emerged as a result of market economic development in the 19th century. China formulated "the Anti-Unethical Competition Law" in 1993. But it needs to be perfected. Although the system of famous trade marks was established in China, the protection of famous trademarks should be defined. The unethical comparative behaviour which refers to making a comparison between one's own commodities and others' in advertisement should be banned. The scope of protection of secrets of commodities should be enlarged. The law should involve settling the problem of faulty behaviour besides banning intentionally unethical competition. The liability for damage should benefit transaction and help encourage the damaged party to initiate legal proceedings.
