Abstract: | Current issues in defamation law are examined and significant practical considerations associated with business-related defamation cases are explored. This is done primarily from the perspective of the corporate defendant, because corporations generally become involved in defamation litigation as defendants. Employment termination-based cases are in focus. Issues and considerations in "corporation vs. corporation" defamation cases are also examined. A "preventive law" section gives corporate managers a set of considerations to follow in an effort to minimize the likelihood that a defamation claim will be brought against their firm. |
