Abstract:This paper discusses the rationale for the differing approaches and looks at whether or not the courts in different countries are gradually changing with the everchanging dynamics of the commercial world. The nature of goodwill has often been described, but it has never been defined. It has been said to be "the attractive force which brings in custom. It is the one thing which distinguishes an old-established business from a new business at its first start".
