| Abstract: | This paper advances the case for negotiations in the near future to institute multilateral rules pertaining only to the national enforcement of competition policies. Recent tensions stemming from competition policies have compelled a reconsideration of the case against multilateral action in such cases. Notwithstanding suggestions in favor of a creative interpretation of existing WTO rules, it can be true that the WTO as it stands offers few possibilities for competition policy-related complaints. Innattention by the multilateral system to these tensions risks undermining it because its integrity depends on minimizing extra-systemic activity. |
