Abstract:Europe hopes to match US success in busting cartels. EU member states are joining the campaign. US influence is also visible in merger control. The US antitrust division strikes the jackpot by refocusing on international cartels increasing fines and jail sentences and encouraging whistle-blowers. The 1996 whistle- blowing notice is a copy of the US version. The broader impact: reorienting EU antitrust law. As leniency programmes proliferate the UK ponders jail sentences with a potentially wider impact. US and European ideas are getting closer. A key is judicial review of merger decisions where the EU is having second thoughts. The author concludes with the theme of an American- inspired revolution.
