Tiivistelmä (eng): | The purpose of the study was to clarify what the current situation is regarding patentability of software-related inventions in Europe and to establish if a compromise in the area could be reached. Research was made to find out what the present situation regarding the patentability for software-related inventions is in Europe. The current situation in Europe was compared to that in the United States. Interviews were performed to hear the opinion of various groups concerned by patentability in the field in both Europe and the US to find a course of action that could satisfy as many as possible. It was found that the opinions among different groups vary remarkably, from those who do find that Art.27 of the TRIPS agreement should be interpreted in a way that would open the way for patents on software algorithms in Europe as is already the case in the US, to those who find that no patents should be granted for inventions comprising the use of software. It was also found that many who are affected by patents in this field do not know what is currently patentable and what is not. To conclude it can be said that the situation regarding the patentability on software related inventions must he clarified and harmonized in Europe and a compromise that will neither nullify granted patents nor allow patents for software as such must be found. |
