| Tiivistelmä: | The legal system for business secret protection in China started with the "law of Anti Unfair Practices in Competition" released in 1993. This law basically aims to serve to regulate the competitive relations between business parties rather than to completely standardize the business secret protection practices. The protection law to be formulated in China should include the following components: 1)protecting the legal rights and interests of the business secret oblige, 2)maintaining the socialist market economic order, 3) safeguarding the social public interest. In addition, the business secret protection law system should be established with the civil law as the basis, the special law for business secret protection being the mainstay and being supported by all the other necessary laws such as labor law, administration law and criminal law. |
