Tiivistelmä: | Fear of incurring liability makes it a common practice among employers to withhold reference information about former employees. Unfortunately, this practice has exposed employers to negligent hiring and retention lawsuits. The case of defamation - which occurs when one person makes a statement, either oral or written, to another person that is false, harms the person's reputation - is described. Increasingly defamation and invasion of privacy cases are appearing in the courts and employees are winning larger verdicts than ever before. In addition, exposure to a lawsuit is diminished greatly by the common law doctrine of qualified privilege. Some guidelines on how to give limited yet correct information about former employees are presented. |
