| Tiivistelmä: | This article presents a forecast of what the future CJEC doctrine in relation to the WTO Agreements may be, based upon both the analysis of past Court decisions and the transformation brought about into,the GATT/WTO system by the Uruguay Round Agreements. For this purpose, Section II provides a brief review of the arguments traditionally mustered by the CJEC to refuse the direct effect of GATT law, in contrast to the position taken with regard to other international treaties. In Section III it analyzes two recent Banana judgments. |
