| Tiivistelmä: | Creditors' rights and the accompanying bankruptcy mechanism are able to play an important and unique role in the governing structure of enterprises. The basic drawback of capital structure of state-owned enterprises is that it can not ensure bringing into full play the function of creditors' rights. This paper analyzes the reasons for "weakening" creditors' rights of state banks and then raises the following suggestions: We should bring into play the due function of creditors' rights in the governing structure of enterprises to overcome the drawbacks. Besides, we should strengthen the legal system to safeguard the legitimate right and interests of creditors and the independency of banking sector to make the business of banks not controlled by the government at very level any more. |
