| Tiivistelmä: | Software conracting is a multifaceted issue that involves legal, economic, managerial and technological considerations. The objectives of the paper are twofold: first, to report several observations of contracting practices, and second, to develop a model of software contracting for studying and aligning divergent interests of the contracting parties. In the first part, the general structure of software contracts in practice is reported, based on five contract forms obtained from various sources. In the second part, a game-theoretic model is developed wich highlights the economic aspect of software contracting. |
