| Tiivistelmä: | An analysis is presented of injury in intellectual property cases. U.S. trade acts are examined from this point of view. The historic background of the question is outlined. A brief discussion of intellectual property rights is presented. Infringement of an intellectual property right is described as the theft of the income stream on an asset. ITC enforcement in this area is reviewed. Problems of injury determination are discussed together with that of industry definition. The ITC is criticized for using a narrow interpretation of the required domestic industry in a number of cases. Suggestions are summarized. |
