| Tiivistelmä: | There are still a number of hurdles before the Commission's grand project for the modernisation of the competition rules sees the light of day. One such stumbling block has been the concern voiced by business, that the new system does not provide companies with adequate legal certainty in concluding their transactions. To dispel what it considers groundless fears, the Commission is campaigning actively to bring business on board. In its most recent effort, the Commission has leaked a Position Paper on "Legal certainty under the new enforcement system", in which the Commission puts its case to the Council. In this paper the Commission replies to some of the criticisms on legal certainty, and details how it will provide guidance in the form of legal opinions for those unresolved, genuinely new questions of interpretation of Articles 81 and 82. |
