Tiivistelmä:Back in the 1980s, experts and executives alike hailed alternative dispute resolution as a sensible, cost-effective way to keep companies out of court. But the great hopes for ADR faded quickly. Damage awards, legal billings, and the number of lawsuits in the United States continued to rise. What had gone wrong? In this article the authors argue that ADR as currently practiced often looks and costs alarmingly like the litigation it's supposed to prevent. Still, a number of companies have learned to use ADR effectively - lowering costs, ending disputes rapidly, and preserving important business relationships.
