| Tiivistelmä: | In the past decade, many state courts have ruled in favor of employees alleging they were improperly dismissed. An evolutionary theory of unjust-dismissal legislation is advanced in which employer groups, responding to the threat of large and variable damage awards imposed by the judicial system, eventually support unjust-dismissal legislation. It is expected that this results in a clear definition of property rights, reduction of uncertainty, and limitation of employer liability. Based on evidence from a case of legislation and an empirical analysis of proposed legislation in a panel of states, several conclusions are drawn. A number of new proposals are presented which may be relevant in a variety of contexts. |
