Tiivistelmä: | The country of origin principle, the cornerstone of the EU Television Without Frontiers Directive is regularly assessed as being insensitive to the justified national public interest to protect viewers of audiovisual content. This article aims to alter this pessimistic perception of the country of origin rule by demonstrating that the potential negative repercussions of the country of origin logic for consumer interest are alleviated in three ways: by Directives specific derogations possibilities in case of violations of the fundamental rules on protections of minor and of human dignity; through the bit of broadcasting control left to the Member States, and by means of an anti-circumvention procedure introduced by new Directive. |
