| Tiivistelmä: | The directors of an insolvent company may be disqualified or ordered to contribute to the funds of the company where wrongful or fraudulent trading has occurred. These three actions may be administered by civil courts but are similar to criminal actions in many ways. In order to determine whether the civil courts are in fact administering criminal law, the definition of crime is analyzed and the civil law remedies examined in the context of that definition. |
