| Tiivistelmä: | Since the promulgation of the Enterprise Bankruptcy law, there are very few bankrupt cases of state-owned enterprises. The main reasons are: (1) The state holds infinite joint liability for the enterprise and without its own property, there is not the so-called "paying debt by capital" for the enterprise. (2) The enterprise, bank and court have the common superior and bankruptcy is decided by superior leaders. The Bankruptcy Law needs market economy. |
