| Tiivistelmä: | The article elucidates some characteristics of the law of reinsurance and the problems with making reinsurance contracts.After the presentation of the idea and the ways of reinsurance the history of the Slovenian reinsurance is presented, then economic part passes into legal part.It speaks about the sources of reinsurance law, about legal definition of reinsurance contract and about making the contract.We get acquainted with contractual parties, with characteristics of the offer and acceptance of offer, with the object, the cause, the form and the duration of the reinsurance contract.Among essential obligations of the reinsured special attention is paid to the principle of uberrima fides and the payment of premium, and in the case of obligations of the reinsurer to the security for payment of reinsurance and the payment of commission (compensation). At the end the author states, that in this phase of development of reinsurance law, taking into consideration the complexity and specific characteristics of business relations and comparative experiences, we do not need legal regulation of reinsurance contract. |
