| Tiivistelmä: | The fact of insolvency triggers off insolvency proceedings too late. Therefore, under the forthcoming insolvency law, the criterion of overindebtedness should ensure a timely beginning of insolvency proceedings. However, overindebted- ness as defined under the new law appears to be insufficient in this respect; it is based on the debtor's subjective judgment concerning the firm's chance of survival which cannot be verified by the creditor. |
