Tiivistelmä:Although the $2.9-million verdict against McDonald's drew considerable headlines in 1994, there was more to that case than just a spilled cup of hot coffee. To begin with, the judge in the case set aside much of the award, reducing damages to $640,000. More important are the facts behind the headlines in this or any other tort case. In the coffee-spill case, attorneys convinced the jury that McDonald's knew its coffee was too hot but did nothing about it. Moreover, the plaintiff, Stella Liebeck, was held partially responsible for the spill, thus reducing her potential award. In contrast to the Liebeck case, hospitality operators have prevailed in other beverage- spill cases, when the facts have shown that the plaintiffs-most of whom were, in fact, injured-knew of the dangers of their piping hot coffee or tea.
