Tiivistelmä:Australian and Chinese economic relations in recent years are summarized; a historical review of the protection of foreign investment is provided. The principles of the Australia-China Investment Protection Treaty are explained, the meaning of "fair and equitable treatment", non-discrimination" and "most favoured nation treatment" is highlighted, government responsibilities under the Treaty are analysed and discussed in detail, with special concern for state responsibility and nationalization, as well as responsibility in relation to foreign exchange control and in government contacts. Settlement of disputes is discussed. The Treaty is considered necessary to establish some basic principles.
