Tiivistelmä: | In the last decade, the courts have become increasingly willing to make exceptions to at-will employment in the USA. Management appears to face several unpleasant alternatives: fighting wrongful termination suits in court, authorizing expensive out-of-court settlements, or tolerating employees whose performance is substandard. To minimize chances of a successful suit, or any suit at all, management must be able to demonstrate that its standards for dismissal include fair play, are well thought out, and are consistent with the need to operate a corporation effectively and with the expectations of a "reasonable employee". |
