| Tiivistelmä: | Although the Court's judgement in Daily Mail case in 1988 provided the occasion to call into question some conclusions on the free movement of companies, which in its absence were widely accepted by commentators, few attempts seem to have been made to re-read the entire case law on the right of the establishment of companies and to seek to reconcile the Daily Mail decision with the previous rulings: this paper, through such re-reading, proposes to contribute to evidence the major issues opened and left unresolved, which are probably bound to become the subject of further debates if, other cases concerned with the right of establishment of business enterprises wil come before the Court of Justice |
