Tiivistelmä:This article considers the core features of the common law in the two areas where the Working Group foresaw impediments. These areas are outlined from a New Zealand perspective. Along the way, the article explains the common law requirement that computer evidence be authenticated prior to admission because this requirement operates hand in hand with the exclusionary rules. It considers and compares differing degrees of statutory intervention in Britain, New Zealand, Australia, Singapore and South Africa in these areas.
