| Tiivistelmä: | The main purpose of the new law of bankruptcy (Insolvenzordnung) is to facilitate reconstruction. This is an unquestionable part of the field of business management and thus a quest for business. The management tasks of the official receiver, as previewed by the new law of bankruptcy, are only gradually different from those faced by the regular management. However, German law leaves juridical advice principally as a privilege of lawyers (Rechtsberatungsgesetz) and so builds an obstacle to the engagement of business in reconstruction. |
