| Tiivistelmä: | The new business law cannot be understood without clear definition of the concepts undertaking and company. Undertaking is a generic notion denoting organized property intended to perform business activities and acknowledged by the legal regulation to be in the nature of a legal person directly or through the bearer of entrepreneurship.In connection with the characteristics of undertaking the definition of two concepts is shown: the concept of undertaking and the concept of the bearer of entrepreneurship.Numerous theories about undertaking have been accepted so far.The author quotes theories about: property dedicated to a certain purpose, the undertaking as a special property of the dealer, complex of activities of property and business possibilities, undertaking as an immaterial good, as a special right, as an object of real right, as a community of property and persons, as a immaterial good of the law as to real property and chattels, institutionalization, community of interests, as a legal person and theory on undertaking as an organization. |
