Tiivistelmä: | Commercial fraud has been described as a growth industry. Some well publicised collapses of companies seemingly attest to that proposition. These kind of business failures have thrown the spotlight on the identification rules of equitable tracing. Tracing issues have also arisen in the context of the ultra vires interest rate "swap" transactions entered into by local authorities in an attempt to get around controls imposed by central government on spending and borrowing. The principles governing identification will be examined in this article in the light of the recent case law. The expression "tracing" is analyzed. |
