Tiivistelmä: | When it comes to the assessment of the GATT-consistency of TREMs, the distinction between product standards, product-related and non-product-related PPM standards becomes vital. How products are made is an important potential factor in determining whether products are "like". The way GATT/WTO is dealing with IEAs in general, and TREMs based on non-products-related PPMs in particular, is highly unsatisfactory. What is needed is an institution which exclusively deals with environmental problems related to transboundary pollution, loss of migratory species and shared living resources, and environmental degradation of the global commons caused by non-product-related PPMs. |
