| Tiivistelmä: | The case of National Westminster Bank v. Hardman in the Court of Appeal, described some time ago in these pages, prompts the view that the decision causes more difficulties than it solves, if only because there was no consideration of the earlier authorities in this area, nor, it is submitted, any attempt to recognize the reality of the transactions in question. There is no reason to assume the ramifications of the decision are any less important than they were in 1987 given the unchanging faces of the typical bank guarantee. |
