Tiivistelmä:The objective of this paper is to clarify the debates by examining the foundations of and the procedures for the WTO's decision-making on the process and production methods based market access rules. To illustrate this, both an import embargo and a mandatory labelling regulation for genetically modified organisms (GMOs) are examined. The strengths and weaknesses of the current decision-making procedure are discussed and options for future negotiations are proposed. The analysis reveals that the WTO has a very structured decision-procedure for determining the legitimacy of PPM-based market access barriers. This procedure signals to all Member states the types of domestic social regulations that they can impose.
