| Tiivistelmä: | As incorporeal asset, commercial secret should possess the following three basic characteristics: unknown to the public ; pragmatic and be able to bring profit to oblige; the oblige takes action to maintain secrecy. The action of infringing on commercial secret should be recognized and executed by the industry and commerce administration office over country level. And the obligee can bring a suit to the People's Court directly asking for compensation. The system of China's legal protection toward commercial secret is taking shape. "Civil Procedure Act" is the first law to regulate "commercial secret". "Several Regulations on Prohibition of Infringing on Commercial Secret" clearly formulates the administrative responsibilities of infringing on commercial secret. And infringing commercial secret that breaks laws must bear legal responsibilities. |
