Tiivistelmä:In England, millions of pounds are spent by National health service (NHS) annually in compensating patients injured during medical treatment. Compensation is paid if the patient can demonstrate treatment has been supplied negligently. However, concern over the cost, effectiveness and administrative efficiency has led jurisdictions like Sweden, New Zealand and some U.S. states to alter the basis for compensation. In the U.K., the Department of Health has published proposals for reform. The article assesses the current approach in England, providing costings for some key alternatives to have featured in the latest policy debate. Lessons are drawn for reform from international experience.
