Tiivistelmä:The trade mark,that is a name serving to distinguish and recognize a product can be estimated as a "mark made on the spirit of the customers". It is of the greatest importance for the producers which,however do not pay the necessary attention to their trade marks. This situation is often due to the wish of the distributors to use their brands (sign marks,generic marks etc.). The solution to the conflict arising between the producers and distributors could be the more active involvement of producers into the distribution and promotion of products bearing their trade mark and more reasoned investment programs including the maintenance of trade marks.
