| Tiivistelmä: | The courts have shown a marked unwillingness to apply equity jurisdiction to commercial contracts creating purely contractual rights between the parties where no transfer of proprietary or possessory rights has taken place. This distinction has led to the denial of equitable relief in the specific context of a time charterparty and license to use trade marks but not in the case of agreements involving the assignment of patent rights or the re-transfer of shares. This article brings together current developments and argues for a more expansive approach towards the granting of equitable relief in the context of purely commercial transactions. |
