| Tiivistelmä: | The current three laws and regulations used for managing foreign trade proxy are "General Rule of the Civil Law of the People's Republic of China", "Foreign Trade Law of the People's Republic of China" and "Interim Provisions for the Foreign Trade Proxy", in which there are some differences in the specific stipulations for foreign trade proxy. The different legal effect will lead to contradictions and conflicts. The provisions of rights and obligation for the foreign trade companies and manufacturing enterprises are not very reasonable and the foreign trade companies bears too much responsibilities in the course of proxy. Therefore, we should perfect "General Rule of the Civil Law of the People's Republic of China" and make it become the legal basis for other laws and regulations. |
