| Tiivistelmä: | An article by Professor Roy Goode Q.C. which criticizes two recent Court of Appeal decisions in which security over book debts or specified contracts was held to be fixed and not floating raises fundamental questions about the nature of fixed and floating security. The following article attempts to take the debate a stage further, in particular, by re-assessing the well-known decision in Siebe Gorman & Co.Ltd.v.Barclays Bank Ltd and by suggestion that, contrary to Professor Goode's view, Re New Bullas Trading Ltd is a correct and helpful decision. |
